I agree with your first and third paragraphs.

As to the second, remember that Obama won the election taking a much stronger stance against the Bush/Cheney policies.  I don&#039;t think opposing the indefinite detention of suspects without any court oversight, for example, is such an unpopular position.  At any rate, it&#039;s certainly hard to test this without having a genuine public debate.  (And besides, rights are not supposed to depend on popular support.)</description>
